1The promoter and the promotion
The promoter is Trendy Deals, the business operating the online marketplace at www.trendydeals.com.au (the "Promoter", "we", "us"). The promotion is the Trendy Deals weekly cash giveaway, in which one prize of AUD $1,000 in cash is offered for each weekly draw (the "Giveaway").
The Giveaway is a trade promotion, also known as a game of chance, run to promote our marketplace. Each weekly draw is a separate trade promotion with a total prize value of $1,000. Draws are not aggregated, combined or carried over, and each draw is conducted and assessed on its own.
2Who can enter
Entry is open to individuals who, at the time of entry:
- are aged 18 years or over; and
- are residents of Australia.
Employees, contractors and officers of the Promoter, and their immediate families, and any person directly associated with conducting the Giveaway, are not eligible to enter or win. We may verify a winner's identity, age and residency before paying a prize, and may disqualify any entry that does not meet these conditions or that breaches these rules.
3How members enter
Automatic entry into the weekly giveaway is a benefit of Trendy Deals membership. While your membership is active, you are automatically entered into each weekly draw held during your paid period. You do not need to do anything further to take part.
Your membership fee is charged for your membership benefits, being 15% off everything storewide and free express shipping. Automatic entry into the weekly giveaway is an additional benefit of your membership and forms only a minor part of the overall membership offering. It is not a separate fee to enter the giveaway, and it does not increase your chance of winning. Limit of one entry per member per weekly draw. Automated, bulk or scripted entries are not valid.
4Draw period and closing time
A new weekly draw is held each week. The entry period, the entry closing time and the draw date and time for each weekly draw are as published on our website for that draw. Only valid entries received before the closing time for a draw go into that draw.
5The draw and how the winner is chosen
The winner of each weekly draw is chosen at random from all valid entries received for that draw, using a fair, chance-based method. One winner is drawn for each weekly $1,000 prize, unless we publish otherwise for a particular draw. Every valid entry has an equal chance of being drawn. The draw is conducted at the place, date and time published for that draw.
6The prize
The prize for each weekly draw is AUD $1,000 in cash, paid by electronic funds transfer to an Australian bank account nominated by the winner. There is one prize per weekly draw.
The prize is not transferable, not exchangeable, and cannot be redeemed for anything other than the cash amount stated. If for any reason beyond our reasonable control a prize is not available, we may provide a prize of equal or greater value, subject to any written directions of the relevant regulator.
7Notifying and paying the winner
We will contact the winner of each draw using the contact details associated with their entry, within a reasonable time after the draw. To receive the prize, the winner may be asked to confirm their identity, age and Australian residency, and to provide bank account details for payment. We will pay the prize within a reasonable time after the winner's details and eligibility are confirmed.
8Unclaimed prizes and redraw
If a winner cannot be contacted, does not respond, or is found to be ineligible within the time we reasonably specify, we may forfeit that entry and conduct a redraw for the prize. Any redraw is held in the same way as the original draw and, where a state or territory requires it, within the timeframe and in the manner set by that jurisdiction's rules. We will announce and pay any redraw winner in the same way as an original winner.
9Winner details and publicity
Where a state or territory requires winners to be published, and as a condition of entry, each entrant agrees that if they win we may publish their first name, last initial and state or territory to announce the result, and may make winner details available to the relevant regulator. We will not publish your full contact details. We will handle your information in line with our Privacy Policy.
10Privacy
We use your membership and entry information so that we can run the draw, verify eligibility, contact winners and pay prizes. We handle this information in accordance with our Privacy Policy.
11Permits and state and territory laws
We run the giveaway in accordance with the trade promotion and gaming laws of each Australian state and territory, and we hold or obtain any permit, licence or authority required. Each weekly draw is run as a separate promotion with a total prize value of $1,000. The prize-value thresholds at which a permit becomes required, and the relevant laws and regulators, are:
- New South Wales: Community Gaming Act 2018 (NSW) and Community Gaming Regulation 2020, administered by NSW Fair Trading. An authority is required only where the total prize value of a single promotion exceeds $10,000.
- Victoria: Gambling Regulation Act 2003 (Vic), administered by the Victorian Gambling and Casino Control Commission. No permit is required for a trade promotion lottery at any prize value.
- Queensland: Charitable and Non-Profit Gaming Act 1999 (Qld), administered by the Office of Liquor and Gaming Regulation. Promotional games require no licence at any prize value where entry is free.
- South Australia: Lotteries Act 2019 (SA) and Lotteries Regulations 2021, administered by Consumer and Business Services. A licence is required only where the total prize value exceeds $5,000.
- Western Australia: Gaming and Wagering Commission Act 1987 (WA) and its Regulations, administered by Racing, Gaming and Liquor. No permit is required at any prize value where the prescribed conditions are met.
- Tasmania: Gaming Control Act 1993 (Tas), administered by the Tasmanian Liquor and Gaming Commission. No permit is required for a trade promotion regardless of prize value.
- Australian Capital Territory: Lotteries Act 1964 (ACT), administered by the ACT Gambling and Racing Commission. A permit is required only where the total prize value exceeds $3,000.
- Northern Territory: Gaming Control Act 1993 (NT) and the Community Gaming Regulations, administered by Licensing NT. A permit is required only for a major trade lottery, being one with a total prize value over $5,000.
Where a permit, licence or authority is required in a state or territory, we obtain it before running the affected draw and display the permit number where the law requires it.
12Australian Consumer Law
Nothing in these rules excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. These rules apply only to the extent the law allows.
13General conditions
- Entries that are incomplete, fraudulent, made through unauthorised means, or that breach these rules, are invalid.
- We are not responsible for entries or messages that are lost, delayed, corrupted or not received due to technical faults or matters beyond our reasonable control.
- To the extent permitted by law, and subject to your rights under the Australian Consumer Law, we are not liable for any loss or damage arising from taking part in the Giveaway or accepting a prize.
- We may vary, suspend or end the Giveaway, or these rules, where reasonably necessary, subject to any approval or direction required by a state or territory regulator. Any change will be published on our website.
- Our decisions on all matters relating to the Giveaway are final, to the extent permitted by law, and we will not enter into correspondence about the outcome of a draw.
14Governing law
These rules are governed by the laws of the State of Victoria, Australia. Your rights under the Australian Consumer Law and the trade promotion laws of your state or territory apply throughout Australia and are not affected by this clause.
