1Your Australian Consumer Law rights
When you buy a Trendy Deals membership, the law guarantees that the service will be provided with due care and skill, will be reasonably fit for any purpose we have told you it is fit for, and will match the way we have described it. These consumer guarantees apply automatically and cannot be signed away.
This policy explains the circumstances in which a refund of your membership fee is, and is not, available. It does not, and cannot, limit any guarantee, right or remedy you have under the Australian Consumer Law.
2What your membership is, and when it starts
The Trendy Deals membership is a paid, ongoing service. The moment your membership payment is confirmed, your membership becomes active and the service is supplied to you in full for your paid period. From that moment you receive:
- 15% off everything storewide, applied automatically at checkout while you are a signed-in member;
- free express shipping on your orders; and
- automatic entry into the weekly $1,000 giveaway.
Your membership fee pays for immediate and continuing access to these benefits for the whole of your paid period. It does not pay for any particular purchase, and it is not a deposit or a store credit.
3The service is used as soon as it starts
Your membership is entered into the $1,000 giveaway automatically as soon as it is active, and again for every draw that runs during your paid period. That entry is a benefit you receive and use straight away. It is delivered the instant you join, it cannot be handed back or reversed, and it is a genuine use of the membership service whether or not you ever place an order.
At the same time, your 15% discount and free express shipping are switched on and held ready for you to use on any order during your paid period. Making these benefits available to you is itself the supply of the service.
For these reasons, the membership service is supplied and used from the start of each paid period, and cannot be returned to us in the way a physical product can.
4Change of mind
The membership fee is not refundable for a change of mind. This includes deciding after signing up that you no longer want the membership, forgetting to cancel before a renewal, signing up by mistake, or simply not getting around to using the benefits.
The Australian Consumer Law does not require a business to refund a service the customer has simply changed their mind about, once that service has been supplied. Because your membership service is supplied to you immediately on payment and is used from that moment (see sections 2 and 3), change-of-mind refunds are not available. This does not affect your rights where a consumer guarantee has not been met, which are set out in section 7.
5Not using your benefits is not a ground for a refund
Your membership fee buys access to the member benefits. It is not a promise that you will use them, and it does not become refundable if you choose not to.
If, during your paid period, you decide not to shop, not to apply your 15% discount, or not to use your free express shipping, the service has still been fully supplied to you. Your discount and free shipping remained available the entire time, and you were still entered into every $1,000 giveaway that ran while you were a member. Non-use of a benefit that was made available to you does not mean the service was not provided, and is not a reason for a refund.
6Auto-renewal, cancellation and no pro-rata refunds
Membership renews automatically at the fee shown at sign-up until you cancel. You can cancel at any time from your account, and cancelling stops the next renewal.
When you cancel, you keep your member benefits until the end of your current paid period, and you will not be charged again after that. We do not give partial or pro-rata refunds for the unused part of a paid period, because the service, including your ongoing draw entries and the availability of your benefits, is supplied for the whole of that period regardless of how much of it you use.
It is your responsibility to cancel before a renewal date if you do not want to be charged again. A reminder that you can cancel at any time does not create a right to a refund for a period that has already started.
7When you are entitled to a refund or remedy
Despite the sections above, you are entitled to a remedy where a consumer guarantee under the Australian Consumer Law is not met. This includes where:
- we fail to make the core member benefits available to you during your paid period, for example your 15% discount does not apply, your free express shipping is not provided, or you are not entered into the $1,000 giveaway;
- the membership service is not provided with due care and skill;
- the membership is not reasonably fit for a purpose we expressly told you it was fit for; or
- the membership is materially different from the way we described it.
Where the failure is major, you may choose to cancel the membership and receive a refund for the unused part of your paid period, or seek compensation for the drop in value. Where the failure is minor, we will first have a reasonable opportunity to fix it, for example by correcting or re-supplying the benefit. We may ask you for details and a reasonable chance to investigate before providing a remedy. You are also entitled to compensation for any other reasonably foreseeable loss or damage caused by a failure to meet a consumer guarantee.
8If a product you ordered cannot be supplied
Your membership and the products you buy from the store are separate things. If you order a product and we or our supplier are unable to supply it, for example because it is out of stock or cannot be delivered to you, we will refund you in full for the amount you paid for that product. Under the Australian Consumer Law, where goods you have paid for are not supplied, you are entitled to a refund of the price of those goods, and we will always honour that.
This does not entitle you to a refund of your membership fee. Your membership is a separate service that was still supplied to you: you remained entered into every $1,000 giveaway, and your 15% discount and free express shipping stayed available to use on other orders. A product being unavailable affects that product order only, and is refunded on the product, not on the membership.
9Billing errors, duplicate and unauthorised charges
Separately from the rules above, if you have been charged in error we will always put it right. Please contact us if you have been charged more than the fee shown at sign-up, charged twice for the same period, charged after a valid cancellation had taken effect, or charged for a membership you did not sign up for. We will investigate and refund any amount that was charged incorrectly.
If you believe your account or payment method has been used without your authorisation, please contact us as soon as possible so we can help.
10Free trials and promotional rates
Where we offer a free trial, or a promotional or introductory rate, the specific terms shown to you at sign-up apply, including when any trial ends and when the standard fee begins. Unless those terms say otherwise, the rest of this policy applies once the standard membership fee is charged. To avoid being charged at the standard rate, cancel before the trial or promotional period ends.

12Governing law
This policy is governed by the laws of the State of Victoria, Australia. Your rights under the Australian Consumer Law apply throughout Australia and are not affected by this clause.
