Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Trendy Deals website at www.trendydeals.com.au and the products and services offered through it (the "Platform"). Please read them carefully. By browsing the Platform, creating an account, purchasing a membership, or placing an order, you agree to be bound by these Terms.

1. Agreement to Terms

These Terms form a binding agreement between you and Trendy Deals ("Trendy Deals", "we", "us" or "our"). If you do not agree to these Terms, please do not use the Platform. We may update these Terms from time to time, and the version published on the Platform at the time you place an order or renew a membership applies. Where changes are material, we will take reasonable steps to notify you. Your continued use of the Platform after an update takes effect means you accept the revised Terms.

2. Eligibility (18+)

You must be at least 18 years of age and have the legal capacity to enter into a binding contract to use the Platform, hold an account, purchase a membership, or place an order. By using the Platform, you confirm that you meet these requirements and that the information you provide to us is true, current and complete. We may refuse, suspend or cancel access where we reasonably believe these requirements are not met.

3. About the Platform

Trendy Deals is an Australian members-first online marketplace. We bring together real brands and products across streetwear, sneakers, appliances, designer bags, jewellery, tools and holiday packages, all in one place.

Trendy Deals is a marketplace only. It is not an auction platform, and there is no bidding of any kind. Orders you place are fulfilled by Trendy Deals' suppliers and partners, who dispatch products directly to you. Because orders may be filled by more than one supplier, dispatch takes a few days. We facilitate the sale and coordinate your order; the underlying product may be supplied by a partner supplier.

4. Membership

Trendy Deals offers an optional paid membership. Members receive 15% off storewide, free express shipping, and entry to the weekly $1,000 giveaway. Membership is charged at the membership fee shown at sign-up.

  • Membership automatically renews at the fee shown at sign-up until you cancel.
  • You may cancel your membership at any time, and cancellation takes effect at the end of your current billing period. You will continue to enjoy member benefits until then.
  • Membership is personal to you and is non-transferable.
  • Membership benefits, including any giveaway, are subject to these Terms and any specific terms published on the Platform for that benefit.

Nothing in this section limits any rights you have under the Australian Consumer Law.

5. Account & Security

To purchase or manage a membership, you may need an account. Trendy Deals uses passwordless sign-in: instead of a password, we send a one-time code to your registered email address, which you enter to access your account. You are responsible for keeping access to your email account secure and for all activity that occurs under your account. Please contact us promptly if you believe your account or email has been accessed without your authorisation. We may suspend or close an account where we reasonably suspect misuse or a breach of these Terms.

6. Placing an Order

When you place an order, you are making an offer to purchase the selected products subject to these Terms. Your order is not accepted until we or the relevant supplier confirm it, typically by sending an order confirmation. A confirmation of receipt does not by itself constitute acceptance.

  • Prices are shown in Australian dollars and are inclusive of GST where applicable.
  • We try to ensure all pricing and product information is accurate, but errors can occur.
  • If a product is unavailable, or is listed at an incorrect price due to a genuine error, we may decline or cancel your order (or the affected part of it) and refund any amount you have paid for it. We will let you know if this happens.

7. Payment

Payment is due at the time of order. You can pay using Zip, Klarna, Afterpay, Laybuy, and debit or credit card via Shopify Payments. Buy-now-pay-later and instalment options are provided by third parties and are subject to their own terms, approval criteria and fees. You must be authorised to use the payment method you select. We do not store full card details; payments are processed securely by our payment providers.

8. Shipping & Delivery

Orders are dispatched by our suppliers and partners and delivered Australia-wide (NSW, VIC, QLD, SA, WA, TAS, ACT and NT). We do not ship internationally. Shipping is governed by our Shipping Policy, which forms part of these Terms. As a guide:

  • Dispatch/processing takes 4-7 business days from payment confirmation.
  • Delivery/transit takes 3-7 business days after dispatch.
  • The total realistic estimate is 7-14 business days. Remote areas may take longer.

These time frames are estimates, not guarantees. Risk in the products passes to you on delivery.

9. Returns & Refunds

Returns and refunds are handled in accordance with our Refund Policy, which forms part of these Terms. Please review that policy for details on eligibility, time frames and how to make a request. Nothing in our Refund Policy or these Terms limits or excludes your rights under the Australian Consumer Law.

10. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

11. Product Information

We aim to describe and display products as accurately as possible. However, product descriptions, images, packaging, colours and specifications are provided as a guide and may vary from the actual product, for example due to your screen settings or changes made by brands and suppliers. Where required by law or our policies, this does not affect your rights in relation to products that are not as described or not of acceptable quality.

12. Prohibited Conduct

When using the Platform, you must not:

  • breach these Terms or any applicable law;
  • provide false, misleading or fraudulent information, or use another person's payment or account details without authority;
  • interfere with, disrupt, or attempt to gain unauthorised access to the Platform, our systems or other users' accounts;
  • use the Platform to transmit malware or engage in any activity that harms Trendy Deals, our suppliers or other users;
  • resell, scrape, copy or exploit content, membership benefits or the Platform for an unauthorised commercial purpose; or
  • abuse, harass or threaten our staff, suppliers or other users.

We may suspend or terminate access where we reasonably believe you have engaged in prohibited conduct.

13. Limitation of Liability

To the maximum extent permitted by law, Trendy Deals is not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data or goodwill, arising out of or in connection with your use of the Platform or the products supplied through it. To the extent we are permitted by law to limit our liability, our total liability to you for any claim is limited, at our option, to resupplying the relevant products or paying the cost of having them resupplied. Nothing in this section excludes or limits any liability that cannot lawfully be excluded or limited, including liability under the consumer guarantees in the Australian Consumer Law.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Trendy Deals, our related bodies corporate and our personnel from and against any claims, losses, liabilities, costs and expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Platform, or your infringement of any law or the rights of any third party. This indemnity does not apply to the extent a loss is caused by our own negligence or breach.

15. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms and explains how we collect, use, disclose and protect your information, including information shared with suppliers and partners to fulfil your orders. By using the Platform, you consent to our handling of your personal information as described in the Privacy Policy.

16. Dispute Resolution

If you have a concern or dispute, please contact us first through our Help Center or Live Chat so we can try to resolve it. We will work with you in good faith to reach a fair outcome. If we cannot resolve the matter between us, you may seek assistance from the Australian Competition and Consumer Commission (ACCC) or your relevant State or Territory consumer protection agency. Nothing in this section prevents either party from seeking urgent relief from a court where appropriate.

17. Termination

You may stop using the Platform at any time and may cancel a membership as set out above. We may suspend or terminate your access to the Platform, an account, or a membership where you breach these Terms, where we are required to do so by law, or where we reasonably consider it necessary to protect the Platform, our suppliers or other users. Termination does not affect any rights or obligations that accrued before it, including payment obligations and your rights under the Australian Consumer Law.

18. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. You and Trendy Deals submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.

19. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be read down to the minimum extent necessary or severed, and the remaining Terms will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Membership terms, Shipping Policy, Refund Policy and Privacy Policy, make up the entire agreement between you and Trendy Deals in relation to your use of the Platform, and supersede any prior understanding or arrangement on that subject.
