1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between TrendyDeals.com.au and any person who accesses or uses this Platform. By using this Platform, you agree to be bound by these Terms, our Privacy Policy, Refund Policy, and Shipping Policy.

2. Eligibility

You must be at least 18 years of age and have full legal capacity to enter into binding contracts under Australian law.

3. Platform Description

TrendyDeals operates as an online auction platform facilitating timed zero-reserve auctions for consumer goods across Australia.

4. Membership

Annual membership is AUD $24.00 per year, auto-renewing via Shopify Payments. Members receive a one-time AUD $24.00 credit toward their first winning auction purchase. Only active Members may place bids. Membership credit is non-transferable, not redeemable for cash, and has no value outside the Platform.

5. Account Access and Security

Accounts use passwordless email authentication via one-time verification codes. You are responsible for maintaining the security of your email account. We are not liable for unauthorised access caused by your failure to secure your email.

6. Auction Rules

Auctions operate on round-based schedules with a global countdown timer. All auctions within a round start and end simultaneously. All bids are final and irrevocable. The highest valid bid at the close of the round wins. Auto-bid is available allowing the system to bid on your behalf up to your specified maximum. Bidder emails are masked in public bid history showing only asterisks and the email domain. The Platform uses server-side time as the sole authority for auction timing.

7. Winning and Payment

Winners must complete payment within 48 hours via Shopify checkout. Failure to pay may result in order cancellation, account suspension, or the product being offered to the next highest bidder. Membership credit is automatically applied to the first winning purchase.

8. Shipping and Delivery

Governed by our Shipping Policy. TrendyDeals ships Australia-wide. Risk passes to the buyer upon delivery confirmation.

9. Returns and Refunds

Governed by our Refund Policy. Change-of-mind returns are not accepted due to the auction format. Your rights under the Australian Consumer Law are not affected.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) or any applicable Commonwealth, State, or Territory legislation. This applies in New South Wales, Victoria, Queensland, South Australia, Western Australia, Tasmania, the ACT, and the Northern Territory.

11. Product Information

We endeavour to ensure product descriptions are accurate. Colours may vary by display. Where a product is materially different from its description, your ACL rights apply.

12. Prohibited Conduct

Users must not manipulate auctions, create multiple accounts, use bots or automated tools, interfere with Platform operations, provide false information, or use the Platform for unlawful purposes. Breaches may result in immediate account termination and referral to authorities.

13. Limitation of Liability

To the maximum extent permitted by law, TrendyDeals excludes liability for indirect, incidental, special, consequential, or punitive damages. Maximum aggregate liability is limited to fees paid in the preceding 12 months. Nothing limits liability for fraud, wilful misconduct, personal injury, death caused by negligence, or any liability that cannot be excluded under Australian law.

14. Indemnification

You agree to indemnify TrendyDeals against all claims arising from your breach of these Terms, misuse of the Platform, or violation of any law.

15. Privacy

Personal information is handled in accordance with our Privacy Policy, the Privacy Act 1988 (Cth), and the Australian Privacy Principles.

16. Dispute Resolution

Disputes shall first be addressed through good faith negotiation, then mediation. Nothing prevents either party from seeking urgent relief or lodging a complaint with the ACCC or relevant State/Territory consumer agency.

17. Termination

We may suspend or terminate accounts at any time for breach, fraud, or operational risk.

18. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. You submit to the exclusive jurisdiction of the Victorian courts and the Federal Court of Australia.

19. Severability

If any provision is found invalid, it shall be severed and remaining provisions continue in full force.

20. Entire Agreement

These Terms, together with all referenced policies, constitute the entire agreement between you and TrendyDeals.
